  • Mishkn, or our affiliates will not be held responsible for, and so held harmless of, any loss whatsoever, harm (including, but not limited to, threat, tort, death), damages whatsoever caused to you resulting from your use of this website or the services we offer, or your reliance on the information or results obtained from such use. However, compensation (completely at the discretion of Mishkn and our executives) will be equal to the amount paid, if any, for the purchase of the cause service.
  • You will not create multiple accounts with us for any unlawful purpose (determined solely at the discretion of Mishkn and our executives).
  • We reserve the right to restrict an account, delete an account, withhold or suspend service from an account, or take other disciplinary measures in order to maintain the integrity of, good functionality of, and order on this website and the services we offer.
  • We reserve the right to modify and make changes to this document (our Terms Of Use) at anytime we see it fit to. We may or may not notify you by any means of such updates: it is therefore your sole responsiblity to frequently check this document so to see if there were updates made and, if so, to see if you agree to them. Your continual usage of our service, or by retaining an account with us, constitutes your acceptance to the updates made, and your agreement to be bound by them.

Customer Responsibilities And Warranties

As a customer with us, you guarantee and are responsible for the following:
  • You will use this website and the services we offer with all sincerity.

Orders

  • Orders are first generated by the Seller. He is required to describe exactly what he wishes to sell, fix the price, and uploads exactly four pictures of what he wishes to sell.
  • After the order generation process, we approve the order if we find it suitable.
  • After the approval of the order, the Buyer will be able to access the generated order to make payment for it.
  • Generated orders that are not paid for within twenty days are automatically closed from the system.
  • After payment for the order by the Buyer, the Seller sends the order package to Mishkn.
  • Upon arrival at Mishkn, the order is validated to check if it agrees with the Seller's description of the order. Validation is done at our sole discretion.
  • If the order passes our validation process, it is sent to the Buyer.
  • If the order fails our validation process, it is rejected and the Buyer is refunded his money in full within 48 hours.
    The Seller, in this case, will bear the full cost of returning the order package to him. The package is costed by Mishkn for return to the Seller. If the Seller fails to pay for the return cost within two weeks from the costing date, a fine for delay (set at our sole discretion) will be added to the return cost. If the Seller fails to pay for the return cost within four weeks from the costing date, we will dispose of the order package as we see fit.
    Within this time, the Seller can come to our location (the one holding the package) to pick it up free of charge, unless it incurred a charge of delay.
  • Once an order passes our validation, refund is no longer possible.
  • If delivery to the Buyer fails and the package is returned to us by reason of the Buyer being unavailable or for inaccurate information provided by the Buyer (or whatsoever fault from the Buyer's side), the Buyer will bear the cost of a follow-up delivery.
    In this case, if the Buyer fails to make the necessary payment for the follow-up delivery within two weeks, there will be a fine for delay (set at our sole discretion) added to the delivery charge. If he fails to make the payment within another two weeks, we will dispose of the order package as we see fit.
    Within this time, the Buyer can come to our location (the one holding the package) to pick it up free of charge, unless it incurred a charge of delay.
  • Once, the package is marked as "Complete", the Seller receives the payment in his account.
  • Orders are automatically marked as "Delivered" ten days after they arrived at Mishkn; and are automatically marked as "Complete" three days after they are marked as "Delivered".
  • An order is marked as "Returned" once it is in transit back to the Seller.
  • When an order is marked as "Disapproved","Returned", or "Completed", their associated order pictures are removed from our servers completely.

Validation

This is the process where we check to ascertain that what the Seller has described in his order is exactly what he has sent to the Buyer upon payment. We check this by physical inspection, comparing the Order Description and Order Pictures with what we have received from the Seller. If we find it to match these parameters, the order passes our validation; if there are discrepancies between these parameters and what we have received, the order fails the validation process.
We reserve the right to pass or fail any order during validation at our sole discretion. We do not use any specialised equipment to test these products to ascertain their authenticity. Buyers and Sellers are therefore urged to ensure that the order descriptions and order pictures well describe their orders.

Payments And Refunds

  • The cost that is displayed within our website is the only amount you will be charged upon payment for the service. Any other charge with which you are charged may originate from your financial institution.
  • In the case of a refund, we refund the amount we charged you during payment for the service. Extra amount charged by your financial institution during the initial payment for the service has nothing to do with us, but your financial institution.
  • If the amount refunded is lower than what was actually paid, do well to contact your financial institution. You may have been charged for the refund.

YOUR USE OF THIS SITE, ITS CONTENTS, AND/OR ANY OF ITS SERVICES IS COMPLETELY AT YOUR OWN RISK. THIS SITE, ITS CONTENTS, AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. NEITHER MISHKN NOR ANY PERSON ASSOCIATED WITH MISHKN MAKES ANY WARRANTY OR RESPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THIS WEBSITE, ITS CONTENTS, AND ITS SERVICES.

Limitation Of Liability
